Overtime Rule Delayed, Again

In our original article, “The New Overtime Law”, we mentioned the upcoming changes to take place to the Fair Labor Standard Act (FLSA) overtime regulations:
“Are you prepared for the overtime law change that takes effect on December 1, 2016? Employees that earn less than             $47,476 ($913 per week) are now eligible for overtime. The previous threshold was set at $23,660. This salary threshold will     continue to rise in the coming years. 4.2 million workers will now be eligible for Overtime under this new law! Compliance must begin on December 1st. Many companies are scrambling to manage this massive increase in the number of employees now eligible to receive overtime pay.”

But several days before the effective date of December 1, 2016, 21 states filed an emergency motion to bar the rule form taking effect for the first time.  At which point, the Department of Labor (DOL) appealed the order that was passed down by the preliminary injunction.  The new deadline was set for May 1, 2017 for a decision to be reached on the fate of the overtime ruling.  Now a third extension has been granted to DOL to June 1, 2017, stating the reason for the delays have largely been attributed to the fact that a new labor secretary has yet to be confirmed. A statement was released by the Department of Labor:
“The due date was previously extended to allow incoming leadership personnel adequate time to consider the issues. The nominee to be Secretary of Labor has not yet been confirmed. Thus, the federal government respectfully requests an additional 60-day extension.”
